1. DEFINITIONS
In these Chicas Curacao general registration conditions, we maintain the following definitions: The website: http://www.chicasproduction.com. Participants: those who register online – as well as through a casting day – a model; Client: the person/party who books participants as a model; User: the operator of the site, being Chicas Curacao BV.
2. APPLICABILITY OF GENERAL CONDITIONS
By registration/use of the website, the participant declares to have taken note of these Terms and Conditions and accept them. Applicability of other general conditions than those on agreements with the participant and/or principal is expressly excluded.
3. OPERATION WEBSITE
The user is working as much as possible to optimize all functions of the website. The participant’s details will be admitted to the user’s database and are made public to possible future clients. The user cannot guarantee the participant any future assignments.
4. PURPOSE OF REGISTRATION
The participant can be asked by the user to function as a model to one or more of the user’s clients. The participant can reject any request. Though after agreeing to a certain assignment participant needs to be present on location as agreed upon with the user.
5. PORTRAIT RIGHT
The participant will receive a quitclaim per assignment from user stating the terms for that particular booking. The participant always signs the quitclaim prior to the shoot. By signing the quitclaim the participant agrees to the conditions and compensation of that particular shoot.
6. PRIVACY PROTECTION
All personal data of the participant will be treated as confidential by the user. The data of the participant filled out on the website are recorded in a central file of the user. The participant gives permission to the user to use this information to obtain assignments. Participant in this connection gives the user the right to bring their photos or personal data, through all forms of media, under the attention of clients. This permission terminates only when participant unsubscribes.
7. LIMITATION OF LIABILITY
The user is not liable for incorrect information participant puts on the website, if such information is made available by participant and user correctly reproduced by the user. The participant will not hold the user responsible for any claims arising from the client or misuse by the client. If participant, without any notice, does not show up or arrive late on a confirmed assignment, costs that may arise will be for the participant.
8. INTELLECTUAL PROPERTY RIGHTS
Every conceivable intellectual property rights to the website and the information is made available on the website are owned by the user. Its members and clients without the consent of the user are not allowed on the site provided information for any purpose whatsoever to use.
9. RESIGN
By sending an email to the user, the participant can resign at any given moment. All quitclaims signed by the participant remain intact.
10. APPLICABLE LAW AND DISPUTE RESOLUTION
The agreements with the participant and/or the client shall apply by the Curacao law. The court in the registered location of the user shall have exclusive jurisdiction to hear disputes between the user and the participant and/or principal, as well as disputes arising from the use of the website by the participant and/or client.
